Announcement No. 23 of 2023: Implementation of Export Control on Gallium and Germanium Related Items by the Ministry of Commerce and the General Administration of Customs of the People’s Republic of China

As approved by the State Council and effective from August 1, 2023, exporters from China dealing with gallium and germanium related items are required to adhere to the relevant regulations and complete the export permit procedures. The export permit documentation must be displayed to the customs.

Further, the customs procedures must be completed in accordance with the “Customs Law of the People’s Republic of China”, and subjected to customs supervision. The customs will handle the release procedures based on the export permit documents issued by the Ministry of Commerce.

Specific items to be controlled include:

Gallium-related items, such as gallium in its elemental form and related compounds. For example, metallic gallium (elemental) (Customs Commodity Code: 8112929010, 8112929090, 8112999000); gallium nitride (including but not limited to forms such as wafers, powders, broken materials, etc.) (Customs Commodity Code: 2850001901, 3818009001, 3825690001); gallium arsenide (including but not limited to forms such as polycrystals, single crystals, wafers, epitaxial wafers, powders, broken materials, etc.) (Customs Commodity Code: 2853909026, 3818009004, 3825690004).

Germanium-related items, such as germanium in its elemental form, related compounds, and materials. For example, metallic germanium (elemental, including but not limited to forms such as crystals, powders, broken materials, etc.) (Customs Commodity Code: 8112921010, 8112921090, 8112991000); zinc germanium phosphide (including but not limited to forms such as crystals, powders, broken materials, etc.) (Customs Commodity Code: 2853904040, 3818009008, 3825690008); germanium epitaxial growth substrates (Customs Commodity Code: 8112921090).
